General Terms and Conditions of Sale (GTC)

Article 1 – Purpose
This general agreement concerns the company MASH, located at 41 Bis rue LEDRU ROLLIN, 44200 Nantes, registered under the number RCS: 983 291 931 (R.C.S. Nantes), and the tenant who has reserved a property by providing his/her personal information either on the reservation platform or via a partner site. The rental conditions, including rates, charges and specific terms and conditions, are defined in the seasonal rental contract, which forms an integral part of this general agreement.

Access to and use of the www.casadisimone.com website and its sub-domains implies automatic and unconditional acceptance of these general terms and conditions. Validation of the booking form and payment of the amounts due at the time of booking signify that the hirer acknowledges and accepts these general terms and conditions, in accordance with French legislation applicable to holiday rentals.

Article 2 – Legal framework of the contract
The signatories acknowledge that this lease does not concern property intended for the principal dwelling, nor for mixed professional and residential use, nor for a second home, nor for residential accommodation. The seasonal lease is exclusively intended for a temporary stay in a furnished tourist accommodation, governed by articles L324-1 to L324-2-1 of the Code du Tourisme and articles 1709 et seq. of the Code Civil. The occupier may not invoke the legal provisions relating to usual residential leases, in particular concerning the right to maintain occupancy of the premises.

Article 3 – Transfer and subletting
This lease is drawn up on a personalised basis for the beneficiary identified at the beginning of the contract. It is strictly forbidden to transfer this lease or to sublet the property, either in whole or in part. The tenant is not authorised to transfer the use of the premises, even free of charge or on loan.

Article 4 – Formalisation of the contract
The contract is deemed to have been concluded as soon as the tenant’s personal and/or financial details have been sent, and the rent has been paid online or by paying a deposit. This validation is equivalent to a handwritten signature, implying acceptance of the terms of the contract and the general rental conditions by both parties.

Article 5 – Booking confirmation
The booking is confirmed on receipt of the deposit corresponding to 30% of the total rental price. A confirmation email will be sent to the tenant to validate the transaction.

Article 6 – Payment methods
Payment of the rent and associated services must be made online in accordance with the following terms and conditions:
– First instalment: a deposit of 30% to be paid at the time of booking by credit card.
– Second instalment: 70% to be paid at least one month before moving in by bank transfer.

Article 7 – Prices
The prices stated on the booking form include all charges and taxes (such as water, electricity, gas, wifi, cleaning after departure, return of keys, tourist tax and administrative costs), with the exception of additional services requested on site.

Article 8 – Security deposit
A security deposit of €1000 is required for the villa and €500 for the flat. This deposit will be taken in the form of a bank imprint on arrival. No amount will be debited, except in the event of damage. The deposit will be returned within 14 days of departure.

In the event of loss or theft of the keys, the tenant must cover the cost of replacing the opening system.

Deodorisation supplement: A supplement of 150 euros may be charged for deodorisation if traces of smoke are detected despite the ban on smoking in the rented premises.

Damage cover: If the security deposit is insufficient to cover any damage, the tenant undertakes to reimburse any additional costs on presentation of supporting documents. The tenant guarantees payment of the expenses and compensation due. If the amount is insufficient, the Tenant undertakes to pay the balance on request by the Owner, on presentation of the appropriate supporting documents.

Article 9 – Non-retraction
There is no withdrawal period for bookings made online, by virtue of article L121-21-8 of the French Consumer Code, which concerns in particular accommodation services booked for specific dates or periods.

Article 10 – Cancellation by the tenant
Cancellation before arrival:
– More than 60 days before arrival: If the cancellation is made more than 60 days before the scheduled arrival date, the tenant will receive a 100% refund, less Stripe fees.

– Between 30 and 60 days before arrival: If the cancellation is made between 30 and 60 days before the scheduled arrival date, the tenant will receive a refund of 50% of the total cost of the stay.

– Less than 30 days before arrival: For cancellations made less than 30 days before the scheduled arrival date, no refund will be given.

– Tenant’s absence: If the tenant does not arrive within 24 hours of the scheduled arrival date, the contract is considered cancelled and the total amount is forfeited to the owner. The accommodation may then be re-let.

Interrupted stay:
– No refund: For an interrupted stay, the total amount of the rental remains due to the owner. No refund will be made for any unused time.

Article 11 – Cancellation by the owner
In the event of cancellation by the owner, the tenant will be refunded all sums paid. If the cancellation is due to exceptional circumstances, no additional compensation will be paid.

Article 12 – Length of stay
The tenant, who signs the contract for a defined period, has no right to extend his stay beyond the planned date.

Article 13 – Arrival and departure
Arrivals are between 4pm and 7pm.

If you are going to arrive late, please let us know by telephone so that we can make the necessary arrangements.

Departures will take place between 8.00am and 10.00am.
We will be on site at the time you have specified to carry out the inventory of fixtures and hand over the keys.

Article 14 – Inventory of fixtures
The inventory of fixtures and fittings and the inventory of furniture and equipment will be drawn up jointly at the beginning and end of the stay, and signed by both parties, the owner or his representative and the tenant.

If, for any reason, the inventory of fixtures and fittings cannot be carried out on arrival, the tenant is responsible for checking their contents and reporting any anomalies, missing or damaged items within 24 hours of arrival. If no comments are made within this time, the tenant will be presumed to have received the premises in good condition and must return them in the same condition, unless there is proof to the contrary (article 1731 of the French Civil Code).

Article 15 – Internet
A Wi-Fi connection is provided free of charge.
The tenant undertakes to use this access in compliance with the laws in force.
The owner accepts no responsibility for fluctuations in the speed of the Internet.

Article 16 – The swimming pool
The swimming pool is accessible and usable from May to October, when the outside temperatures are pleasant enough for swimming. However, it is important to note that the pool is not heated. Water temperatures therefore depend on the season’s weather conditions.
Children remain under the strict supervision of their parents or guardians.
Access to the pool is strictly forbidden to all non-renters.

Article 17 – Use of the premises
The accommodation is provided to the tenant in a perfect state of repair and in accordance with its description. The tenant is required to use the accommodation with care and in accordance with its intended purpose.

The tenant must comply with the following rules:

  • Use the premises only for temporary and private purposes, for a tourist or professional stay.
  • Ensure that only the signatory of the contract and any accompanying persons occupy the premises, without exceeding the stated capacity. No third party may benefit from the rental.
  • Avoid any action likely to disturb the peace and quiet of the neighbourhood. In the event of a complaint about a nuisance, the tenant alone will be held liable.
  • Comply with the rules, regulations and ordinances in force, particularly in terms of health, safety, roads, police, public health and public peace.
  • Parties and other events are not permitted.

 

Article 18 – Accommodation capacity
The accommodation is equipped with sufficient furniture to accommodate a maximum of 8 people. Unless prior agreement has been obtained from MASH, the addition of extra beds and the accommodation of extra people are not authorised. Please note that a child is counted as one person. In the event of non-compliance with this provision, the contract will be terminated immediately without refund.

Article 19 – Animals
Animals are not permitted in the villa or flat.

Article 20 – Insurance
The tenant is responsible for all damage caused during his/her stay and must be covered by holiday insurance for rental risks such as theft, fire and water damage.
The owner insures the accommodation against rental risks.

Article 21 – Visiting the premises
The owner may visit the premises on request.

Article 22 – Smoking
Smoking is prohibited inside the villa or flat, including at the windows.

Article 23 – Disputes
Any complaint must be made within 48 hours of moving in. In the event of a dispute, the court of the rented property shall have sole jurisdiction. However, all consumers are reminded that they have the right to contact a consumer ombudsman in order to try to resolve their dispute with a professional out of court.
